He was at fault, he also had no drivers license, lapsed Insurance, and was driving for lyft. I filed an accident report and exchanged information with him. Now... To sue or not to sue, that is the question. Bueller? Lehto? Bueller?

Agreed - since he was an agent for Lyft at the time, I would come after them for allowing an unlicensed employee driving for them. I’m not well-versed in how insurance works for Uber/Lyft/etc - I know when folks are driving for them, they’re covered by the company’s policy, right? So, technically he might have been insured. That said, he had no license, which is a big oops on Lyft’s part.

No need to sue until you’re sure that he isn’t going to pay to fix your car.
EDIT: Even if he doesn’t pay up you might want to just use your insurance/own money and call it a day. If hes that much of a scumbag, you’ll just waste time and money on the legal process and maybe still not get paid.

Many moons ago, by ‘85 was similarly rear ended. It was a kid, and we exchanged contact info, admitted he was at fault, please don’t call his parents, etc, etc. A few days later, after not hearing from him, I called his parents. Their response was that I had an old POS and my bumper was probably already smashed in. Hmmm.
So, I had a friend that was an attorney who offered to send them a nastygram on legal letterhead for me. I got a check within a week.
I’d sue, but I’m not what will happen with someone that already can’t apparently afford a license or insurance. Sure seems like Lyft would be mighty interested in this as well.

You have to ask yourself if lawyers fees, court costs, etc involved in suing will exceed the estimate to fix the damage.
Odds are they will.
I’d honestly just go to the junk yard and get a bumper and exhaust. I can’t imagine it’d be too expensive.

Do you have a lawyer in the family, or legal insurance? As much as I want this sucker to feel the pain, there is no point in trying to grab into a naked man’s pocket. This idiot has not money, so you might end up with lots of legal fees that you will never see back. Get a bumper from a pull-a-part and forgive and forget. Maybe report him to Lyft?
Or sue them? But that’s a bit of a longshot.

He could pursue Lyft due to insufficient vetting, but the driver has no coverage through Lyft for any insurance. He’s an independent contractor required to furnish his own insurance.

I was under the impression that Lyft and Uber drivers were considered independent contractors. That would make suing Lyft or Uber and being successful VERY difficult.

I would try pursuing him in small claims court. There’s not nearly enough money at stake here to be worth hiring a lawyer. The dude is probably an empty bag anyways.

The 4.0 sounds great with a flowmaster. I have the 50 and had the 40 series on my manual. The 40 was louder and I would rev it. The 50 is ok on the auto. It gives it a growl and not a terrible drone on the highway.
Bumpers are pretty cheap froma junkyard. 4 - 15mm bolts per side holds the brackets on.

Normally, someone with no license and lapsed insurance is probably not going to be worth the effort of suing. But since he was driving for Lyft at the time, maybe there’s something there. I don’t do auto accidents but it would probably be worth your time to consult a local auto accident attorney for a better idea of what your options could be.

I’m really not sure why this is such a huge discussion. Suing is (I’ve done it) an immense use of time and effort and in this situation may not get you anywhere due to Lyft worker’s status as independent contractors. So you get your insurance involved, I personally see $120 at a muffler shop and $80 at a pick-n-pull for a new bumper worth of damage, or just keep driving it and give no fucks because IIRC you already give no fucks about this truck since you have your Ranger.

Lyft had liability insurance that paid for my car and my property damage. (My car was hit parked at the end of my driveway and was pushed into my gate and then the stone retaining wall). They would not cover their driver’s car. Since the driver didn’t have his own insurance, he had no collision coverage.
Police were involved and they found the Lyft drive was intoxicated. I sued because the driver wouldn’t admit liability so Lyft didn’t want to pay me. I submitted my security tapes and they coughed up for all of the damages immediately, and eventually my lawyer’s fees after some prodding.
I do believe that the Lyft passenger was/still is suing Lyft for their driver being intoxicated.

My insurance would total it as policy due to age and also give it an irreparable title because of some stupid environmental bullshit reasons.
A friend of mine kissed a guardrail on a slippery bridge in her pristine ‘97 XJ, only crunching her bumper and pulling a fender flare off. They totalled it and paid out $3700 (even though she paid $3600 four years and 100,000km previous) even though I could have fixed it for about $200 in junkyard parts in a few hours. I was going to buy it from her but couldn’t beat the insurance, so I figured I’d pick it up at closed-bid auction for $700, but it already had a rebuilt title and so they said “second total loss irreparable”. Not the environmental bs reason but still bs all the same.
There are certain aspects to this socialized insurance I don’t like at all. Not many, but they’re pretty big ones.
I hope things work out for you. Even if you can’t get anything out of Lyft (or the driver) it’ll be pretty cheap for a junkyard bumper and the exhaust won’t be much either, but I’d go new with that. I recommend side pipes.

I’m not sure about Colorado law. This stuff varies wildly from state to state. But if nothing else, you can usually sue in small claims court for some amount (which is more than you might guess but less than you are deserving of). Of course, he probably isn’t collectible but it’s always fun to try .
